Bubbly Terms of Use

Please read these Terms carefully before downloading or installing Bubbly (the "Software"). These Terms are a legal agreement between Rivon Labs ("we" or "us") and the individual or entity using the Software ("you").

By downloading, installing, or using the Software, you agree to these Terms. If you do not agree, do not install or use the Software, and delete it if you have already installed it. In particular, please read Section 7 (Disclaimer of Warranties) and Section 8 (Exclusion of Damages), which limit your rights.

1. License

  1. We grant you a non-exclusive, non-transferable, limited license to install and use the Software on Mac computers that you own or control.
  2. The Software is licensed, not sold. We reserve all rights not expressly granted to you in these Terms.
  3. The Software includes features you can use for free and paid features unlocked with a purchased license key ("Pro"). Section 10 sets out the terms for Pro.

2. Restrictions

Except to the extent expressly permitted by applicable law, you may not:

  1. reverse engineer, decompile, or disassemble all or any part of the Software, or otherwise attempt to derive its source code, algorithms, or internal structure;
  2. modify, adapt, or translate the Software, or create derivative works based on it;
  3. copy and distribute, rent, lease, resell, transfer, or sublicense the Software, or include it in another program or installer for distribution, without our prior written consent;
  4. remove, disable, or circumvent any protection included in the Software, such as license verification, license key checks, code signing, or update verification;
  5. remove or alter any copyright, trademark, or other proprietary notice shown in the Software; or
  6. use the Software to violate any law or to infringe the rights of others.

If your breach of this Section causes us loss, we may claim compensation from you.

3. Ownership

  1. We or our licensors own the copyright and all other intellectual property rights in the Software and its documentation. The Software is protected by copyright laws and international copyright treaties.
  2. We own the rights to the Bubbly name, logo, and characters (Bub, Mochi, Bolt, and Boo). These Terms do not grant you any right to use them.

4. Updates and Beta Versions

  1. If you allow it, the Software periodically checks for new versions. Updates are downloaded and installed only with your consent.
  2. These Terms apply to any updates we provide. Updates may add or change features, and we are not obligated to provide updates. However, we will not, without reasonable cause, remove features provided as part of Pro or change them to your disadvantage. Our update commitment for Pro is set out in Section 10.
  3. Versions we label "beta" are for testing and may contain more errors or different features than release versions.

5. Internet Connection and Privacy

The Software connects to the internet only when necessary for normal operation, such as checking for updates and verifying Pro licenses, and it does not send the content of your notifications outside your Mac. Our Privacy Policy describes how we handle personal information and network communication.

6. Third-Party Components

The Software includes open-source components developed by third parties (such as Sparkle and GRDB) and a font (Galmuri11), each subject to its own license. To the extent such a license provides otherwise than these Terms, that license prevails. A list of these components and their license texts is available in the Software's About screen and on the open-source notices page of our website.

7. Disclaimer of Warranties

  1. The Software is provided "as is." To the maximum extent permitted by applicable law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  2. We do not warrant that the Software will operate without interruption or error, that it will display every notification, or that every error found will be corrected. Changes in macOS or other factors may prevent the Software from displaying notifications in place of macOS; in that case, notifications may appear in the standard macOS style.
  3. However, if Pro does not work as we described, you may request a refund under Section 10 and applicable law.

8. Exclusion of Damages

  1. To the maximum extent permitted by applicable law, we are not liable to pay monetary damages for any loss arising out of or in connection with the use of, or inability to use, the Software, including but not limited to losses caused by missed notifications, loss of data, loss of business, and indirect, incidental, special, or consequential damages.
  2. If you are not satisfied with the Software, your remedy is to stop using it and, if you purchased Pro, to request a refund under Section 10.
  3. Paragraphs 1) and 2) do not apply to damages caused by our intentional misconduct or gross negligence, damages for death or personal injury, or any other liability that cannot be excluded or limited under applicable law.
  4. If applicable law prevents paragraph 1) from taking effect and we become liable for damages, then, except for damages described in paragraph 3), our liability will not exceed the amount you actually paid for the Software.

9. Termination

  1. You may terminate these Terms at any time by deleting the Software.
  2. If you breach Section 2 (Restrictions), we may terminate your license. If the breach involves circumventing a license key or other protection, we may deactivate the relevant Pro license and, unless applicable law requires otherwise, will not refund the purchase price.
  3. Upon termination, you must stop using the Software and delete all copies. Sections 2, 3, 7, 8, 12, and 13 survive termination.

10. Pro (Paid Features)

  1. Pro is purchased through the checkout of Polar (polar.sh). Polar acts as the merchant of record and handles payment, taxes, and license key issuance. In addition to these Terms, Polar's purchase terms apply to your payment.
  2. Pro is a one-time purchase, not a subscription. One license key can be activated on up to three Macs, and you can deactivate Macs yourself in the Polar customer portal.
  3. Pro purchasers receive Bubbly 1.x updates at no additional cost. Major versions from 2.0 onward may be sold separately.
  4. The price is the amount shown at checkout. We may change the price of future sales, but such changes do not affect licenses already purchased.
  5. To request a refund, email contact@rivonlabs.com. Your license key is deactivated when a refund is issued.
    • If you have not activated your license key: within 7 days of purchase.
    • If Pro differs from its description or advertising or does not work as described: within 3 months of purchase, and within 30 days from the date you became aware, or could have become aware, of the issue.
    • After you activate your license key, refunds for a change of mind are not available due to the nature of digital content. You can preview Pro styles for free before you buy.

11. Changes to These Terms

  1. We may change these Terms to the extent permitted by applicable law.
  2. When we change these Terms, we will post the changes and their effective date on our website at least 7 days before they take effect. Changes unfavorable to you will be posted at least 30 days before they take effect and also announced separately, for example within the Software.
  3. If, when giving notice under paragraph 2), we clearly state that you will be deemed to accept the changes unless you object before the effective date, and you continue to use the Software after the effective date without objecting, you will be deemed to have accepted the changes. If you do not agree, you may stop using and delete the Software.
  4. Changes unfavorable to you apply to Pro licenses already purchased only with your consent.

12. Governing Law and Jurisdiction

  1. These Terms are governed by and construed in accordance with the laws of the Republic of Korea. The court with jurisdiction over any dispute relating to these Terms or the Software is determined under the Civil Procedure Act of Korea.
  2. However, these Terms do not limit any mandatory rights that the laws of your country of residence grant to consumers.

13. General

  1. Matters not covered by these Terms are governed by applicable laws, including the Copyright Act and the Act on the Consumer Protection in Electronic Commerce.
  2. If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.
  3. These Terms are provided in Korean and English. If the two versions differ, the Korean version prevails.
  4. Please send questions about these Terms or refunds to contact@rivonlabs.com.

Effective date These Terms take effect on October 28, 2026.
